1. Data Controller

The data controller responsible for your personal data is Clq Inc, a SASU (société par actions simplifiée unipersonnelle) registered under SIREN 103 333 886, with its registered office at 47 Rue Vivienne, 75002 Paris, France.

2. Data We Collect

We collect the following categories of personal data:

• Account information: email address, display name, and profile information provided during registration or through OAuth providers (Google, Discord, Twitch).
• Stream metadata: stream titles, thumbnails, categories, tags, and chat messages you send on the Service.
• Payment data: payment information is processed by PayPal. Clq Inc does not store full card numbers. We retain only the transaction records necessary to provide the Service.
• Technical data: IP address, browser user agent, and interaction data collected through Cloudflare Turnstile for bot protection and security purposes.

3. How We Use Your Data

We use your personal data for the following purposes:

• Service delivery: to provide, operate, and maintain the streaming platform, including account management, content delivery, and communication features.
• Analytics: to understand how the Service is used and to improve its performance and features.
• Abuse prevention: to detect, prevent, and address fraud, abuse, security issues, and violations of our Terms of Service and Acceptable Use Policy.
• Communication: to send you service-related notifications, such as changes to our Terms or Privacy Policy, and to respond to your inquiries.

4. Legal Basis (GDPR)

We process your personal data on the following legal bases under the General Data Protection Regulation (GDPR):

• Contract performance: processing necessary to provide the Service you have requested, including account management and content delivery.
• Legitimate interest: processing for analytics, abuse prevention, and service improvement, where such interests are not overridden by your rights.
• Consent: where we require your consent for specific processing activities, we will obtain it before processing begins.

5. Third-Party Processors

We share limited personal data with the following third-party processors who act on our behalf:

• PayPal: payment processing. PayPal processes your payment data in accordance with its own privacy policy. PayPal may transfer data outside the EEA under appropriate safeguards.
• Cloudflare: content delivery network (CDN), Turnstile bot protection, D1 database, and R2 storage. Cloudflare processes data in accordance with its privacy policy.
• Backblaze: cloud object storage for media assets. Backblaze processes data in accordance with its privacy policy.
• Hetzner: infrastructure hosting for compute and streaming servers. Hetzner processes data within the EU in accordance with its privacy policy.

6. Data Storage & Transfers

Our primary infrastructure is located within the European Union (Cloudflare, Hetzner). Some data may be stored on infrastructure located outside the EU (Backblaze B2). Where personal data is transferred outside the EEA, we ensure appropriate safeguards are in place, including Standard Contractual Clauses where applicable, to protect your data in accordance with GDPR requirements.

7. Data Retention

We follow a minimal data collection and retention policy:

• VOD and clip content: retained according to your plan tier (see our Terms of Service for retention periods). After the retention period, content is permanently deleted.
• Account data: retained while your account is active. Upon account closure, your personal data will be deleted within 30 days, except where retention is required by law.
• Chat messages: retained on a per-stream basis and deleted in accordance with content retention policies.

8. Your Rights Under GDPR

Under the GDPR, you have the following rights regarding your personal data:

• Access: you may request a copy of the personal data we hold about you.
• Rectification: you may request correction of inaccurate personal data.
• Erasure: you may request deletion of your personal data, subject to legal retention obligations.
• Portability: you may request your data in a structured, machine-readable format.
• Objection: you may object to processing based on legitimate interest.
• Restriction: you may request restriction of processing in certain circumstances.

9. Data Export & Deletion

You may request a full export of your personal data or the deletion of your account and associated data by contacting [email protected]. We will respond to your request within 30 days. Upon account deletion, your personal data will be removed except where retention is required by applicable law.

10. Cookies & Tracking

Streamown uses only essential cookies necessary for the operation of the Service, such as session authentication. We use Cloudflare Turnstile for bot protection, which may set a cookie to verify that you are a human user. We do not use third-party advertising cookies, social media tracking pixels, or analytics cookies that track you across other websites.

11. No Third-Party Advertising

Streamown does not serve third-party advertisements and does not sell, rent, or share your personal data with advertisers. Your data is used solely to provide and improve the Service.

12. Data Breach Notification

In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, Clq Inc will notify affected users within 72 hours of becoming aware of the breach, in accordance with GDPR requirements. Where required by law, Clq Inc will also notify the Commission Nationale de l'Informatique et des Libertés (CNIL).

13. Children's Privacy

Streamown is not intended for use by individuals under the age of 13. We do not knowingly collect personal data from children under 13. If we become aware that we have inadvertently collected personal data from a child under 13, we will take steps to delete such information promptly.

14. Changes to This Policy

Clq Inc may update this Privacy Policy from time to time. We will provide at least 30 days' notice of material changes via email or a platform notification. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Privacy Policy.
