Terms of Service
1. Acceptance of Terms
By accessing or using Streamown ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Clq Inc, a SASU (société par actions simplifiée unipersonnelle) registered under SIREN 103 333 886, with its registered office at 47 Rue Vivienne, 75002 Paris, France.
2. Definitions
- "Service" means the Streamown streaming platform, including all features, functionality, website, and applications offered by Clq Inc.
- "Creator" means a user who broadcasts live content or uploads recordings on the Service.
- "Viewer" means a user who watches, interacts with, or consumes content on the Service.
- "Content" means any live stream, video, clip, chat message, image, text, or other material made available through the Service.
- "Platform" means the infrastructure, software, and services operated by Clq Inc to deliver the Service.
3. Account Registration & Eligibility
You must be at least 13 years of age to create an account and use the Service. By creating an account, you represent that you meet this age requirement.
You may register using an email and password, or through third-party authentication providers (Google, Discord, or Twitch). You are responsible for maintaining the security of your account credentials. You may not create more than one account per person. You must provide accurate and complete information during registration and keep your account information up to date.
4. Creator Obligations
As a Creator on Streamown, you agree to:
- Keep your stream key confidential and not share it with any third party.
- Ensure that all content you broadcast is owned by you or that you have all necessary rights and licenses to stream it.
- Comply with the plan tier you are subscribed to, including viewer caps and feature limitations.
- Provide accurate and non-misleading metadata for your streams, including titles, categories, and tags.
5. Viewer Obligations
As a Viewer on Streamown, you agree to:
- Conduct yourself respectfully in chat and other interactive features.
- Not engage in harassment, hate speech, or disruptive behavior.
- Not record, reproduce, or redistribute any content without the Creator's permission.
6. Subscription & Payment Terms
Creators may subscribe to paid plans to access additional features. Payments are processed through PayPal. By subscribing to a paid plan, you authorize Clq Inc to charge the applicable fees to your PayPal account.
How billing works
Streamown uses a dual billing model. As a Creator on a paid plan, you are billed two separate charges each month:
- Fixed monthly plan fee — charged automatically via your PayPal subscription at the start of each billing cycle.
- Variable monthly charge — charged separately via PayPal autopay at the end of each billing cycle. This covers:
- Viewer-hour overage: if your stream used more viewer-hours than your plan includes, the excess is billed at the overage rate.
- Platform fee: a percentage of all tips and membership payments received that month.
A viewer-hour is calculated as: concurrent viewers × hours streamed. For example, 10 viewers watching a 2-hour stream generates 20 viewer-hours.

The platform fee is applied to the gross amount of each tip or membership payment received by the Creator. Clq Inc does not calculate or collect VAT on your behalf.
Autopay requirement
To stream on a paid plan, you must connect a PayPal account and enable autopay. Autopay is required to collect the variable monthly charge. If autopay is not configured, your ability to stream may be suspended until it is set up.
Cancellation. You can cancel your paid plan at any time from the dashboard. Cancellation is immediate: your PayPal subscription is canceled, your plan drops to Free, and paid-plan features (streaming beyond Free limits, VOD retention beyond Free, overage allowance, etc.) are revoked right away. All payments are final — no prorated refund is issued for the unused portion of the current billing cycle. If you wish to use your plan until period end, do not cancel until then.
7. Viewer Caps, Viewer-Hours & Plan Enforcement
Each plan tier imposes a concurrent viewer limit. When the number of concurrent viewers exceeds the cap for your tier, additional viewers will be unable to connect until capacity becomes available. To accommodate more concurrent viewers, you must upgrade to a higher plan tier.
In addition to the concurrent viewer cap, each plan includes a monthly viewer-hour allowance (see the pricing table in Section 6). Viewer-hours consumed beyond the included allowance are billed at the overage rate via the variable monthly charge.
8. Content Retention
Streamown retains VOD recordings and clips based on your plan tier. After the retention period expires, content is permanently deleted and cannot be recovered.

9. Stream Duration
All plans (Starter, Growth, and Creator) have no daily stream duration limit.
10. Content Ownership & Licensing
You retain all ownership rights to content you create and broadcast on Streamown. By making content available through the Service, you grant Clq Inc a limited, non-exclusive, royalty-free license to deliver, host, transcode, and stream your content on the Platform for the purpose of providing the Service to you and your viewers.
11. Prohibited Content
You may not broadcast or upload content that:
- Contains explicit sexual or 18+ material.
- Depicts graphic violence, gore, or real-life harm.
- Promotes or facilitates illegal activities.
- Involves gambling or casino games for real money.
- Contains hate speech, including slurs or advocacy of discrimination based on race, ethnicity, gender, religion, sexual orientation, disability, or other protected characteristics.
- Constitutes harassment, doxxing, or targeted abuse of any person.
- Contains malware, viruses, or instructions for hacking or exploiting systems.
- Infringes the copyright, trademark, or other intellectual property rights of any third party.

12. DMCA & Copyright
Clq Inc respects the intellectual property rights of others and expects its users to do the same. If you believe that content on Streamown infringes your copyright, you may submit a takedown notice via ourDMCA Notice page.
After receiving a valid takedown notice, Clq Inc will remove or disable access to the allegedly infringing content. You may submit a counter-notification if you believe the content was wrongly removed.
Repeat infringer policy: Clq Inc operates a three-strike system. Upon receiving three valid DMCA takedown notices against a single account, the account will be permanently terminated.
13. Termination & Account Suspension
Clq Inc may suspend or terminate your account at any time for violations of these Terms or theAcceptable Use Policy.
Enforcement process: Clq Inc generally follows a three-strike system: (1) a written warning for the first violation, (2) a temporary suspension (typically 7 days) for the second violation, and (3) a permanent account ban for the third violation. Serious violations may result in immediate permanent termination without prior warning.
You may close your account at any time by contacting [email protected]. Upon account closure, your content will be removed in accordance with the retention policies described in Section 8.
14. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Clq Inc does not guarantee uninterrupted or error-free operation of the Service.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Clq Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. Clq Inc's total liability shall not exceed the amount you paid to Clq Inc in the twelve (12) months preceding the claim, or the minimum amount required by applicable law, whichever is greater.
16. Indemnification
You agree to indemnify, defend, and hold harmless Clq Inc and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your content; or (c) your violation of these Terms.
17. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with French law. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Tribunal de Commerce de Paris.
18. Changes to Terms
Clq Inc may update these Terms from time to time. We will provide at least 30 days' notice of material changes via email or a platform notification. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
